A Couple Of Questions From A Newbie

Hi everyone,

I am new to this website, and considering to post my work on it seriously. I have some questions and hope to get some answers.
a) Can I draw some portraits of celebrities/royal families/politicians?
b) Can I draw famous pictures 200 years ago? eg. Mona Lisa
c) About using Photoshop, can I use the software to strengthen the color? Can I change the background?
d) I was told the pricing is up to the artist, but how much should be reasonable? I don't want to list too high or too low. How do you decide?
e) Normally how many days will take to pass the quality control of the website?

Yes you can. You might not be able to sell them however.

You represent and warrant that:

(A) You have the full right, power and authority to enter into this Contributor Agreement and to fully perform all of Your obligations hereunder;
(B) You are under no legal disability or contractual restriction that prevents You from entering into this Contributor Agreement;
(C) The Images and all parts thereof are owned and/or controlled by You, unencumbered and original works and are capable of copyright protection in all countries where copyright or similar protection is available;
(D) If the Images contain any human likeness from which an individual may be identified, You own or have acquired all rights to use such human likenesses;
(E) If the Images contain third-party trademarks including design marks, the inclusion of the trademarks is pursuant to license or written consent or qualifies as a lawful use under U.S. intellectual property laws;
(F) The Images are neither obscene nor defamatory and do not infringe the copyright or any other rights of any third party, including, without limitation, trademark rights and the rights of privacy and publicity;
(G) There is no suit action or claim or other legal or administrative proceeding now pending or threatened which might directly or indirectly affect the Images or which might in any way impair the rights granted by You hereunder.

You are solely responsible for the Content that You upload or post to the Website or any material or information that you transmit to other Contributors.

Up to you, Nobody can help you. There is a thread on this right near yours. Take a look

e) Normally how many days will take to pass the quality control of the website?

If you sell an image we will refuse to print if the image shows.......

Pixellation
Blockiness
Bad cropping
Blurriness not in keeping with the image (ie not meant to be there)
normal font signature (Arial, Times New Roman etc)
signature cropped half off the image
large watermarks
noticeable camera flash
Upsized images

We do not do quality control until you sell so, it is your responsibility to quality control your images carefully before uploading. You do this by zooming in a photo editor to 100% and then carefully going over the image, checking for the above defects

though abbie gave the clinical answer, you have to be very careful with it. partly because the image you take the image from - is copyrighted usually. and the person in the shot also has rights to the use of the image. it may not be worth the time to make anyone famous because several people can take you to court. your better off doing things that are not people because of this.

that is in the public domain, so yes, but.... why? because its out there, anyone can make anything. and i'm not sure if old paintings are really in, these days.

c) About using Photoshop, can I use the software to strengthen the color? Can I change the background?
there is no such thing as being a purist, use the program to enhance all of it, clean it up etc. your more or less expected too... however if your selling the original, and its very red on the screen and pink in the drawing, people may not like that.

d) I was told the pricing is up to the artist, but how much should be reasonable? I don't want to list too high or too low. How do you decide?
that's up to you, there is a thread about that right now, look up rich franco. start low, work your way up if you sell. right now you have nothing and i can't offer any advice at all. you'll need to be here for a week, with an avatar and have 10 things if you want to be in the search. and if your drawing, that might take a while.

e) Normally how many days will take to pass the quality control of the website?
there is no quality control. only if it sells, then they look. then if it fails, you have to fix it, just make sure the image is clean and clear when you send it here. not a fast snap with a phone in a dark room, while riding in a bumpy car.

you can ask, or i just shout out and tell you if i see work that looks bad.

Although there is a specific category for celebrity images, which legally there shouldn't be, I wouldn't use celebrities without permission as you could be sued, or at least receive a cease & desist order from celebrity reps.If it were you, would you want anyone making money by using you as subject matter without your permission?

Are you a lawyer Michael Rodrick?

There are probably a billion celebrity images spread out over every internet site in the world that sells art. I doubt that even 20% of them have permission from the celeb.

I would never in a million years ask perfect strange via chat room or message board what I can sell or what I can't.

The only valid answer here, IMHO is the one that comes from Abbie, and the one you get from your lawyer.

As far as FAA goes, there are people and galleries here that every right to sell celebrity images which makes that category very much appropriate. You have no idea who does or does not have permissions of copyright agreements for the art they sell.
