This is in regards to content providers, all of us, I even have an app in the Play Store for my FAA Premium Site. I am buried but it is there. Or it was for years. Not sure now.

Since copyright is the economics of our content and this is a legal decision I will add it. For FAA to have an app it matters.

I don't like that Mickey is falling into the public domain, even though it's just the earliest version. I think that if a character's owners are still using the character, then they should have exclusive rights to it. But that's just me.

Great thread Sharon! Those in the UK especially might find this article useful: http://www.epuk.org/opinion/stolen-photographs-what-to-do It's a bit old but most of the info is still current. There's plenty of other info on the EPUK website, and dealing with infringments and using the UK's Small Claims court to demand payments from infringers are frequent topics in the members email discussions, (you dont have to be British or in the UK to sign up).

We want to avoid discussions and opinions in this thread because it's too easy for it to become an angry rant/attack thread. Keeping it sterile and businesslike is the way to go here for all of us.

The courts have decided that AI creations are not protected by copyright. Why would anyone create anything with AI and then whine about not being able to copyright it?

Regarding AI replacing jobs, we need to study history and see where all industries have lost jobs due to advancements in technology throughout time. It's called progress. This is nothing new and, in the long run, has created many more new jobs than jobs lost.

Does anyone have an update on UK law?

Under English law, specifically the Copyright, Designs and Patents Act 1988 (“CDPA”), artistic works created by a computer can benefit from copyright protection (although there is no copyright registration system in the UK). Section 178 of the CDPA provides that a “computer generated” work is one that is generated by a computer in circumstances where there is no human author of the work. The “author” of a computer-generated work is the person who made the necessary arrangements to create the work. Such works will be protected for 50 years from the end of the calendar year in which they were created. The UK approach therefore separates authorship and creativity. Assuming their comic is an original work of intellectual creation (the standard for protection in the UK and indeed the EU), if Kashtanova had created their work as a UK citizen or for a UK company, it is likely the work would have automatically benefited from copyright protection in the UK.

The current position in the UK indicates that AI-generated works can be protected by copyright which is distinctly different to the USA’s position. However, following the UKIPO consultation the UK government has kept the law under review and considering the commentary from the oral evidence session could amend, replace or remove protection in future. Therefore, as AI develops, and its use becomes more prevalent it will be interesting to observe how the legal position in both the UK and USA adapt and change.

"If there’s one thing we’ve learned from recent developments so far in 2024 in infringement cases against generative AI companies, it’s that plaintiffs are getting wiser about what claims to bring and are now focusing almost entirely on claims of direct infringement for input-side copying. Motions to dismiss either haven’t challenged those claims, or they have, and courts have rejected them.

We’re also seeing very strong cases brought by corporate copyright owners (e.g., New York Times, Universal Music) that show irrefutable evidence of unauthorized copying. To that end, we’re also beginning to see the emergence (in court filings) of a position that AI companies have promoted over the last few years: that any copying done for training purposes qualifies as transformative fair use.
